Dementia Care: Finding the Resources You Need

Finding quality dementia care is an important concern for countless families —and something we handle a lot with our clients at Rothkoff Law Group. The news recently reported Bruce Willis—an actor needing no further introduction—is stepping back from acting because he suffers from aphasia. Speculation furthered that he is suffering from cognitive impairment or dementia. This news felt oddly personal. I grew up watching Bruce in Die Hard, Die Hard II, as well as the other installments, along with countless other films of his. Beyond the personal effect, it also illustrates the hard truth that age-related illness, like dementia, knows [...]

Advocating for Quality Long-Term Care in Pennsylvania

At Rothkoff Law Group, advocating for quality long-term care in Pennsylvania is a part of our day-to-day. As our loved ones age, their need for healthcare and personal assistance tends to increase. Whether your loved one is in the early stages of dementia, undergoing short-term rehabilitation after hospital admission, or in need of long-term nursing home care, accessing the best care and figuring out how best to pay for it can be overwhelming burdens. Wherever this journey begins, advocacy is important to address all of these issues. In pursuit of quality long-term care in Pennsylvania, our clients are often surprised [...]

Living Will and Dignified Aging: Have the Conversation

As loved ones age, having the discussion on dignified aging and a living will can be challenging and emotional for families. Considering that spring is arriving and it appears the world may be opening up a bit more (hopefully), families will start reconnecting, spending quality time together, and planning vacations. Since the start of the pandemic, many families forewent these gatherings in an effort to avoid unnecessarily exposing themselves or loved ones to COVID-19. However, since late 2021 and increasingly so, families are spending more time together. Considering how long it’s been since these families have sat together, this may [...]

2022 Consumer Electronics Show Features Elder Care Technology

Big tech is lending its innovations to the care of seniors with new elder care technology. As I’ve written before, care costs (whether acute or long-term) continue increasing, as they have for years. As elder care advocates we deal with these growing costs daily and have seen this trend for years. However, another issue has risen over the past year or two: a dearth of caregivers. The number of CNAs, home health aides, and LPNs is dwindling for a variety of reasons: a growing need by aging adults, the pandemic, low pay, hard work, and reduced immigration. As a result, [...]

The Role of Private Equity Ownership in Nursing Home Care

In this week's blog, we discuss the role of private equity investment in nursing homes and what states are doing to address these issues. Nursing homes owned by private equity firms have higher mortality rates, according to the National Bureau of Economic Research (NBER). Over the past 18 years, private equity (PE) investment in nursing homes increased 20-fold, from $5 billion to $100 billion. “Private equity’s business model involves buying companies, saddling them with mountains of debt, and then squeezing them like oranges for every dollar,” so says United States Representative Bill Pascrell from New Jersey, of PE companies purchasing [...]

Pennsylvania Updates Nursing Home Regulations

Acknowledging that current statewide nursing home regulations are insufficient to meet the physical, psychological, and social needs of residents, Pennsylvania announced a number of changes this past week.  One of the most significant being a 35% increase in direct care provided to each nursing home resident -  4.1 daily hours, up from 2.7. Although lessons learned from the COVID-19 Pandemic contributed to these new nursing home regulations, studies show that raising the number of care hours improves the quality of care, prevents infections, falls, malnutrition, and dehydration.  In short, more care creates better outcomes. Of course, any new law, regulation, [...]

Thank you, Marie: An Anecdote from an Elder Care Lawyer

As an elder care lawyer, I have had the privilege of meeting and assisting countless families and seniors over the years. And over those years, some stand out in the mind…like Marie. In February 2017, Marie left her home and transitioned to a personal care home. Her husband was in poor health and in a nursing home. She had no children and needed an elder care lawyer to help her navigate these changes. Given her situation, Marie’s close friend scheduled a meeting with myself, Kathleen Magee, our Director of Care Coordination, and Marie to discuss how our team of elder [...]

Can a Nursing Home Require Vaccination of Residents and Staff?

A recent article in the Doylestown Patch detailed that Neshaminy Manor, a Bucks County, Pennsylvania nursing home, announced they will require all staff to accept the COVID-19 vaccination.  Those staff that choose not to vaccinate risk losing their jobs.  This naturally leads to the question - Can a nursing home require vaccination of staff as a condition of continued employment?  Can any employer?   The answer is rather murky. Generally, if failure to vaccinate puts other employees, clients, or the public at risk of infection, then employers may require vaccination as a condition of an employee’s return to work.  This is [...]

There is No Place for Politics in Elder Care Law

It is my personal opinion that there is no place for politics in elder care law. I recently discussed the election during a dinner conversation with a friend. We discussed our political views and opinions. He correctly observed he never sees political opinions on my Facebook or LinkedIn pages. He inquired why I chose not to engage in a political discussion, suggesting whether it was because I wanted to be perceived as apolitical from a business perspective. In a way, he was right, but not for the reasons he thought. Many years ago, I represented an elderly stroke survivor whose [...]
