Biden Administration Announces Significant Nursing Home Reform

In an effort to improve the quality of care for nursing home residents, the Biden Administration has announced plans for sweeping nursing home reform. As you are aware, the pandemic has been devastating to nursing home residents. COVID-19 has not necessarily caused all the recent issues with nursing homes. Issues regarding staffing, quality of care, and private investors’ role in the nursing home industry has existed long before anyone heard of COVID-19. The pandemic simply brought these issues to the surface. As a result, on February 28, 2022, the Biden administration announced it would be implementing a variety of nursing home reforms, including the [...]

Important Update on Nursing Home Visitation Guidance from CMS

On November 12, 2021, the Centers for Medicare & Medicaid Services (CMS) updated their Nursing Home Visitation Guidance. After over a year and a half of residents and their loved ones being separated from each other and subject to confusing and often ignored nursing home visitation guidance, visitation is now allowed at all times for all residents, including indoor visitations.  All visitors must continue to adhere to infection prevention practices. Additional key points of new guidance include: Facilities can no longer limit frequency and length of visits, number of visitors, or require advanced scheduling of visits. Vaccinated and unvaccinated residents [...]

Update on Rothkoff Law Group

We have attempted to provide some semblance of normalcy regarding our services and outreach after over 18 months of revamping business practices and our interactions with clients and our professional partners. We originally scheduled in-person professional appreciation events for the end of September and a client appreciation event for early December, as we have done in previous years. Unfortunately, due to the Delta variant, we decided to postpone these large in-person events and will reschedule them and/or turn these events into a virtual event. We believe we have a duty to protect our senior clients, the public, and our [...]

The Pandemic Did Not Change Everything

The Covid-19 pandemic has changed the way we live and communicate with one another in various ways, including scheduling virtual meetings, a significant reduction in travel, and reduction or elimination of large in-person gatherings. However, some important aspects of life have not changed, not all necessarily for the better. In late August, news broke that 91-year-old actor Ed Asner died. Asner became famous for his role as Lou Grant, the crusty newspaperman on the Mary Tyler Moore Show, then later as Lou Grant on his own TV drama from 1977-82. He was also the lovable voice of Carl in “Up,” [...]

Nursing Home Visitation

Unfortunately, nursing home visitation and visits to long-term care communities in NJ, PA, and beyond are once again being limited or restricted due to residents and/or staff contracting the COVID-19 virus. We have seen the devastating consequences of visitation restrictions on long-term care residents. During the past year, long-term care advocates have called for each community to allow for an “essential caregiver” during a health care emergency.  In June 2021, a bill was introduced in Congress to recognize essential caregivers. The Essential Caregivers Act (H.R. 3733) is bipartisan legislation that would give nursing home residents the right to have access [...]

Pennsylvania Updates Nursing Home Regulations

Acknowledging that current statewide nursing home regulations are insufficient to meet the physical, psychological, and social needs of residents, Pennsylvania announced a number of changes this past week.  One of the most significant being a 35% increase in direct care provided to each nursing home resident -  4.1 daily hours, up from 2.7. Although lessons learned from the COVID-19 Pandemic contributed to these new nursing home regulations, studies show that raising the number of care hours improves the quality of care, prevents infections, falls, malnutrition, and dehydration.  In short, more care creates better outcomes. Of course, any new law, regulation, [...]

Where is My Third Stimulus Check?: Possible Problems

As your friends and family receive their third stimulus checks, you may have grown increasingly worried about the status of your own economic impact payment. Due to some changes in check distribution this time around, your third economic impact payment may still be coming. Additionally, the IRS is no longer providing assistance via phone, as they did for the first stimulus payments, instead encouraging those eligible to check the status of their payment through the IRS's payment tracker tool, which you can access by clicking here. If your payment has been delayed, the most common reasons are outlined below. Where [...]

Update on Rothkoff Law Status

As we move into the second year of dealing with the effects of COVID-19, at the present time, most of our office team continues to be hard at work with the assistance of technology. We continue to be very productive working remotely, and are at the office when needed to meet with clients or perform tasks they cannot accomplish remotely. However, as more of our clients and staff are fully vaccinated over the coming weeks, we expect to start engaging in more in-person client appointments and have more staff return to the office. However, we will continue to give our [...]
